for users of micropayment payment services

Micropayment (hereinafter referred to as "payment service provider") is a technical service provider specialized in the electronic processing of cashless payments. The payment service provider offers a technical platform and the interfaces to settle payments for its partners (hereinafter referred to as "website operators").
The payment service provider supplies the website operator with technical services for realizing payment transactions.
User is everyone who uses the technical payment system of the payment service Provider by submitting his payment data for offers of the website operator.
- Scope
- These General Terms and Conditions (hereinafter referred to as: GTC) shall apply in the respectively valid version for each use of the payment services of the service provider.
- These GTC for users can be viewed in multiple languages. All versions, with the exception of the German version, are translations only. Therefore, only the version in German is legally binding.
- Contractual relationship and right of withdrawal
- A legally binding contract is concluded exclusively between the website operator and the user. The service of the payment service provider takes place on behalf of the website operator.
- If the website operator uses the services of the payment service provider, he is obliged to offer and make known to his users fair return and cancellation rules.
- Cancellation, return or refund claims must be directed directly to the website operator.
- The user is not entitled to use the services of the payment service provider for false statements or other activities that are prohibited by German law and / or applicable law in the respective country of origin of the user and / or by their distribution the reputation of the service provider or the website operator is overwhelmingly damaged.
- Limitation and availability of services of the service provider
- The maximum number of possible bookings and the maximum amount of a payment transactions may, for the purpose of minimizing a fraud risk and depending on the chosen payment method, be subject to limitations determined by the website operator.
- The payment service provider operates powerful server systems in its own server network in Germany and endeavors to ensure the proper operation of its services at all times. However, there is no uninterrupted usability or accessibility.
- Liability
- The payment service provider is not liable for technical transmission delays.
- The payment service provider is liable to the user only in case of intent or gross negligence for any self or caused by legal representatives or vicarious agents unlimited damages. In the event of slight negligence, the service provider is liable to the user only in the event of injury to life, limb or health.
- The offer of the payment service provider is limited exclusively to the technical implementation of payment services on behalf of the respective website operator. For the design and content of the website, to which the payment systems of the payment service provider are integrated, the sole responsibility is with the respective website operator, i.e. he is solely responsible for his website and is solely responsible for any infringement of third party rights.
- Privacy policy
- The payment service provider takes the protection of personal data very seriously. All data of the user are treated very confidentially and in accordance with the legal data protection regulations, in particular according to the regulations of the EU General Data Protection Regulation.
- The user can obtain information on the respective data processing process for the payment method of the service provider used by him in the corresponding data protection information of the payment service provider.
- The data of the user are stored exclusively in a separate data center of the service provider in Germany and not for the purpose of advertising to third parties.
- Final provisions
- Should individual provisions of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the remainder of the rest remains unaffected.
- The ineffective or unenforceable provision shall be replaced by an effective and enforceable provision whose effect comes closest to the economic objective pursued by the parties with the invalid or unenforceable provision. The above provisions shall apply mutatis mutandis in the event that the contract proves to be incomplete.
